Liability Waiver Agreement

By registering for an event with Dr. Samantha Kinkaid and Stillwater Coaching and Wellness (“the Event”), you acknowledge and agree to be bound by the terms of this Liability Waiver Agreement (“Agreement”). If you do not agree to the terms of this Agreement, do not register for an Event with Dr. Samantha Kinkaid and Stillwater Coaching and Wellness.

1. Agreement to Follow Directions

I agree to follow all instructions and guidelines provided by Dr. Samantha Kinkaid and Stillwater Coaching and Wellness before, during, and after the Event. I understand that failure to adhere to these instructions may increase the risk of injury or harm.

2. Assumption of Risk

I acknowledge that participation in the Event involves inherent risks, including but not limited to physical exertion, mental and emotional challenges, and unforeseen circumstances. I voluntarily assume all risks associated with my participation, including any injury, illness, or damages that may occur.

3. Affirmation of Physical and Mental Health

I affirm that I am physically and mentally fit to participate in the Event. I have disclosed any relevant medical conditions to Dr. Samantha Kinkaid and Stillwater Coaching and Wellness, and I take full responsibility for monitoring my own health and well-being throughout the Event.

4. Release and Indemnification

I hereby release, waive, and forever discharge Dr. Samantha Kinkaid, Stillwater Coaching and Wellness, their affiliates, employees, agents, and representatives from any and all claims, liabilities, or damages arising out of or in connection with my participation in the Event. I agree to indemnify and hold harmless Dr. Samantha Kinkaid and Stillwater Coaching and Wellness from any claims, demands, or causes of action brought against them as a result of my actions or negligence during the Event.

5. Dispute Resolution

In the event of any dispute arising from this Agreement or my participation in the Event, I agree to first attempt to resolve the matter through friendly negotiations with Dr. Samantha Kinkaid and Stillwater Coaching and Wellness. If a resolution cannot be reached, both parties agree to seek an amicable solution through mediation before pursuing any legal action.

6. Online Agreement

I agree that this Agreement may be signed electronically or agreed to by clicking “I Agree.” This electronic acknowledgment has the same effect as signing by hand, and both parties intend to be bound by all terms of the Agreement.

I understand that by checking this box and registering for an Event with Dr. Samantha Kinkaid and Stillwater Coaching and Wellness, I am agreeing to be bound by the above terms.
